Privacy Policy

Our Commitment to Privacy

International Shipping Compliance, S.A. ("ISC", "we", "our", or "us") is committed to protecting the personal data of all individuals who use the ISC Driver Mobile Application (the "App"), including employees, subcontracted drivers, independent contractors, temporary workers, agents, and other authorized users. This Privacy Policy is issued in accordance with the laws of the Republic of Panama, including Law 81 of 2019 and Executive Decree No. 285 of 2021, and aligned with applicable United States data protection and biometric privacy principles.

1. Information We Collect

We collect information that you provide directly, information collected automatically, and information received from third parties.

1.1 Information You Provide

• Identification documents and user credentials

• Contact information (email address, phone number)

• Biometric information, including facial images (selfies) used for authentication

• User-generated content such as photographs, journey evidence, incident notes, and reports

1.2 Information Collected Automatically

Location Information:

• Real-time GPS coordinates during active journeys

• Location history with timestamps

• Background location data when the App is running

Device and Technical Information:

• Device type, operating system, identifiers, IP address, language, and app version

Usage Information:

• App usage metrics, crash reports, logs, diagnostics, and session data

1.3 Information from Third Parties

• Information provided by employers, contracting entities, or authorized clients

• Authentication and analytics data from service providers

2. How We Use Your Information

Personal data is processed for the following purposes:

• User registration, authentication, and account management

• Journey tracking, logistics monitoring, and operational control

• Evidence documentation and incident management

• Security, fraud prevention, and access control

• Legal, regulatory, and contractual compliance

• Customer support, audits, and internal operations

3. Biometric Data
3.1 Categories of Biometric Data

ISC collects facial images, biometric templates, and facial geometry data used exclusively for authentication and security.

3.2 Purpose and Use

Biometric Data is used solely for identity verification, access control, fraud prevention, and security of App operations.

3.3 Optional Sharing with Technology Partner

With separate, express, and optional consent, Biometric Data may be shared with ISC’s technology partner solely for improving and developing facial recognition software. Such sharing is NOT a condition of using the App and may be withdrawn at any time via App settings or by contacting ISC.

3.4 Prohibited Uses

ISC does not sell, lease, trade, or use Biometric Data for marketing or advertising purposes.

4. Location Information

IMPORTANT NOTICE: This App collects location data continuously during active journeys, even when the App is closed or not in use. 

We collect: 

• Real-time GPS coordinates with latitude and longitude 

• Location history including timestamped location points 

• Background location data when the App is running in the background 

• Route information including distance travel and speed 

• Geofencing data for designated areas or checkpoints

The App collects real-time and background location data during active journeys to ensure operational integrity, safety, and compliance with contractual and regulatory obligations.

5. Data Security

ISC implements administrative, technical, and physical safeguards, including encryption, access controls, audits, employee training, and incident response procedures as follows:
We implement reasonable administrative, technical, and physical security measures to protect your data, including:

• Encryption of data in transit (TLS 1.3) and at rest (AES-256)

• Regular security audits and penetration testing

• Access controls and authentication requirements

• Employee training in data protection

• Incident response procedures

6. Third-Party Services and SDKs

The App uses third-party services and software development kits (SDKs), including but not limited to:

• The Technology Partner’s Trueface SDK: Facial recognition and biometric authentication

• Firebase Crashlytics: Crash reporting and performance monitoring

7. Your Privacy Rights and Choices

In accordance with Panamanian Law 81 of 2019, all users of the App — including employees, subcontracted drivers, independent contractors, and other authorized users — have the right to:

  • Access their personal data

  • Rectify inaccurate or incomplete data

  • Request cancellation or deletion, when legally applicable

  • Object to certain processing activities

  • Request data portability, when applicable

  • Withdraw consent at any time, without retroactive effect

Biometric Data:

  • Biometric authentication may be required for secure access.

  • Any optional sharing of Biometric Data with technology partners requires separate, express consent and is not a condition of using the App.

  • Consent may be withdrawn at any time through App settings or by contacting info@iscapp.io.

The exercise of these rights will not result in retaliation or adverse treatment.

8. International Data Transfers

To operate the App, personal data may be stored or processed in countries other than the user’s country of residence, including the United States.

ISC ensures that international transfers:

  • Comply with Panamanian data protection laws

  • Are subject to appropriate contractual and security safeguards

  • Are limited to the purposes described in this Privacy Policy

By using the App, users expressly authorize such international data transfers.

9. Data Retention

Data is retained only for as long as necessary for operational, legal, or contractual purposes. Biometric Data is deleted when no longer required or upon lawful withdrawal of consent.

10. Workforce-Specific Provisions

This Policy applies equally to employees and non-employees. Nothing herein creates or modifies an employment relationship or labor classification.

11. Changes to This Privacy Policy

App User will be notified via an app update when there is a change to this privacy policy. During the app update, users will be prompt to review the update policy to provide consent. Any previous consent provided on previous policy is invalidated.
